Henderson Short-Term Rental Regulations

City Code of Ordinances

The City Council of Henderson adopted rules governing the operation of short-term vacation rentals ("STVR"). The city of Henderson defines short-term rentals as a permanent residential dwelling or any portion of such dwelling unit, rented for occupancy for a period of less than thirty (30) consecutive calendar days, or, in February, less than 28 consecutive calendar days, counting portions of day as full days, regardless of whether a permanent resident is also present during the period of occupancy.

A two-night minimum booking is required for non-owner occupied and one night for owner-occupied property.

If your property is located within an individually mapped multi-unit development (i.e., condominiums), the number of units permitted to register is 1 unit of 10 percent of the number of units within the building, whichever is greater. Short-term vacation rentals are prohibited in apartment units.

Occupancy is limited to four occupants for the first bedroom and two occupants per additional bedroom as listed with the Clark County Assessor’s Office as of the registration date, up to a maximum of 16 persons.

A short-term vacation rental shall not be within 1,000 feet of another registered short-term rental. The distance shall be measured as a radius from the property line of the registered short-term vacation rental to the nearest property line of the proposed short-term vacation rental. Business License Requirements

Any property owner wishing to operate a short-term vacation rental must register their property with the City. The City of Henderson does not require a business license to operate an STVR.  Effective July 1, 2022, all registrants must obtain a State of Nevada business license.

Effective July 1, 2022, each property owner is limited to a maximum of 5 registrations per State of Nevada business license held by that owner. Visit the State of Nevada Secretary of State page for more information.

Certification is required for the property owner of record and the registered local contact person. If your local registered contact is a property manager licensed under NRS 645, certification is not required; a copy of the state license will be required at the time of registration. Building and Housing Standards

Henderson has rules and regulations that specify minimum building, design, maintenance standards, habitability, health, and safety requirements. Some rules and regulations that apply to residential and non-residential properties may apply to your listing. Tourist and Local Taxes

All STVRs registered with the City of Henderson will be required to submit the Report of Tax Collected on Room Rentals and pay transient lodging tax on a monthly basis.

Other Rules

The registered owner is required to send out the local contact information to properties within a 200-foot radius.

A long-term renter is not allowed to rent the property as a short-term rental.

It is also essential to understand and abide by other contracts or rules that bind you, such as leases, condo boards, co-op rules, HOA rules, or rules established by tenant organizations.
