City Code of Ordinances

Fullerton defines a short-term rental as a permanent residence or a portion of a permanent residence (single or multi-family), where lodging is provided for compensation for fewer than thirty consecutive days. As a result, these units may be subject to any land use restrictions, permit or licensing requirements, fees, or taxes that may be in effect in the city.

Business License Requirements

A short-term rental permit issued by the Community and Economic Development Department that allows the use of a privately owned residential dwelling as a short-term rental unit is required. Applicants who have been given a short-term rental permit must also get the business registration and transitory occupancy certificate mandated by Chapter 4 of the Fullerton Municipal Code.

Building and Housing Standards

The City of Fullerton has rules and regulations that specify minimum building, design, maintenance standards, habitability, health, and safety requirements. Some rules and regulations that apply to residential and non-residential properties may apply to your listing. Consult Building Code for more information.

Tourist and Local Taxes

Each short-term rental is subject to and required to pay a tax of 10% of the operator's monthly fee. The tax is an obligation the renter owes to the city that can only be settled by paying the operator or the city.

Other Rules

It is also essential to understand and abide by other contracts or rules that bind you, such as leases, condo boards, co-op rules, HOA rules, or rules established by tenant organizations. Please read your lease agreement and check with your landlord if applicable. Visit the City of Fullerton for more information.
