Miami Beach Short-Term Rental Regulations

City Code of Ordinances

Vacation/short-term rentals are forbidden in all single-family residences and many multifamily housing structures in certain zoning zones of Miami Beach, according to the Miami Beach City Code (Sec 142-1111) and the City Code (Sec 142-905 (b)). Pursuant to the Miami Beach City Code (Sec 102-386), vacation/short-term rentals are only permitted in certain zoning districts of Miami Beach.  View the Short-Term Rental Zoning Map to determine if your property qualifies.

Business License Requirements

The first step is to obtain a Florida Department of Business and Professional Regulation (DBPR) and State Vacation Rental Dwelling License. After that, if you are permitted to operate a short-term rental property owner must obtain a Vacation/Short-Term Rental Business Tax Receipt. To create an online account, go here. Log into the Citizen Access Portal after creating an account to register your property as a business.

Building and Housing Standards

Miami Beach has rules and regulations that specify minimum building, design, maintenance standards, habitability, health, and safety requirements. Some rules and regulations that apply to residential and non-residential properties may apply to your listing. Please consult Chapter 14 of the Code of Ordinances and contact the Code Compliance Department for more information.

Tourist and Local Taxes

Tourist taxes are imposed by the city of Miami Beach, Miami-Dade County, and the state of Florida on short-term leases of accommodations lasting less than six months. To learn more about City, County, and State taxes, visit the municipal code, the county government website, and the state's FAQ page, respectively. Miami Beach also enforces Resort Tax Certificates if property owners plan to sell food, beverages, and alcoholic beverages. They are required to register and remit resort tax to the City of Miami Beach. There is a 4% tax on the rent of a room or rooms in any hotel, motel, rooming house, or apartment house. Other Rules

Please take note that any condo association/HOA hosts must have a letter from the association/HOA indicating that short-term rentals are permitted, dated within 60 days of the application date (and the condo association/HOA must also have its own business tax receipt).
