City Code of Ordinances
Short-term rentals are prohibited in areas of Daytona Beach zoned for residential uses. Short-term vacation rentals are only permitted along some major thoroughfares where hotels and motels are allowed and in certain areas of the beachfront, downtown, and Midtown. They're allowed in four different tourist zoning districts and thirteen different redevelopment area zoning districts. A city-issued occupational license is required to conduct business in Daytona Beach. The Florida Department of Business and Professional Regulations (DBPR) requires all transient rental types to register. To find out if you need a DBPR license or for more information, click here. All of Daytona Beach’s businesses are required to have a current Business Tax Receipt, which expires on September 30 of each year.Building and Housing Standards
Vacation rentals in Daytona Beach are defined as Other Accommodations: A dwelling unit that is rented or leased to transient persons or tourists for less than six months. This use does not include motels, hotels, or bed and breakfast inns (generally rented on an overnight basis). This use continues to recognize and regulate all other "accommodation" uses (including short-term rental lodging) that were recognized and regulated by the previous LDC and thus continue to be grandfathered from the effect of statutory limitations on local regulation of vacation rentals that were enacted subsequent to the City's recognition and regulation of such use. Other accommodations shall comply with the following standards: Accessory Uses. Except as expressly provided otherwise, the following standards shall apply to all accessory uses to other accommodations:- No more than 20 percent of the gross floor area of the other accommodations use may be devoted to accessory uses.
- The accessory use shall be designed to primarily serve short-term rental lodging guests.
- The accessory use shall be located within the principal building of the other accommodations development and accessible only from an interior court, lobby, corridor, or pool deck.
- There shall be no outside advertising or signage for the use.
- If the accessory use involves the sale of alcoholic beverages for on-premise consumption, it shall comply with the standards in Section 6.20, Alcoholic Beverages.
Tourist and Local Taxes
The property owner must also register for the Tourist development tax, known as “resort tax” or “bed tax,” a local option transient rental tax collected by Volusia County. You must register with the Florida Department of Revenue for a Sales Tax Number before applying for a Volusia County Tourist Tax account.Other Rules
