City Code of Ordinances

Short-term rentals are unregulated in Fontana unless you are outside of the city limit. The current Zoning and Development Code does not address vacation or short-term rentals.  You can check out the Zoning for Fontana here. Ordinances and Zoning are subject to changes and should always be confirmed with the Fontana Code Compliance Unit Department.

Business License Requirements

Fontana doesn’t have any regulations pertaining to registering short-term rentals. If applicable, apply for all State and County licenses.

Building and Housing Standards

Fontana has rules and regulations that specify minimum building, design, maintenance standards, habitability, health, and safety requirements. Some rules and regulations that apply to residential and non-residential properties may apply to your listing. Please consult the Fontana Code of Ordinances and contact the Building & Safety Department for more information. 

Tourist and Local Taxes

A 7% Transient Occupancy Tax is levied by San Bernardino County on amounts paid by guests for stays of less than 30 days. You'll need to file for a Transient Occupancy Tax Registration Certificate to collect the tax. Every quarter, the county tax office sends a form to every active certificate holder. Short-term rentals might be subjected to state sales tax and are liable for payment as established by state law.

It is also essential to understand and abide by other contracts or rules that bind you, such as leases, condo boards, co-op rules, HOA rules, or rules established by tenant organizations.
