Sandy Springs Short-Term Rental Regulations

City Code of Ordinances

Sandy Springs regulates short-term rentals. Short-term rentals are defined as “any non-subsidized house, apartment, condominium, room or lodging accommodation on any property within the city that is rented to the same tenant for a period of less than 30 days. A short-term rental unit shall be located inside or adjacent to its owner's occupied dwelling located on the same property. The definitions and regulations in this chapter shall be cumulative to those found in section 7.3.1(D) of the city's Development Code.” All owners or hosts shall give notice of the operation of a short-term rental unit to all residential parcels and/or homeowner's association(s) immediately adjacent to the short-term rental unit. For more information, see Sandy Springs Chapter 26 Article XII - Short Term Rental Ordinance

Business License Requirements

The owner of the property must have a city business license, and the unit must be registered as a short-term rental unit. Business Occupational Tax Certificate (Business License) for new applicants must be completed in person at the City Hall. A short-term rental unit permit is valid for one year from the date of issuance. Any advertisement for a short-term rental unit must include the business license number. All owners, platforms, and managers of multiple short-term rental units shall register and provide detailed records of rental activity and taxes by rental unit. 

Building and Housing Standards

Sandy Springs City has rules and regulations that specify minimum building, design, maintenance standards, habitability, health, and safety requirements. Some rules and regulations that apply to residential and non-residential properties may apply to your listing. Before the issuance of a permit for a short-term rental unit, each property containing a short-term rental unit shall be inspected for compliance with all building and fire codes.  All parking for short-term rental units shall be accommodated on the same lot as the short-term rental unit. All owners or hosts shall post the city's noise ordinance in a visible location in the short-term rental unit. Please consult the Sandy Springs Building Code Ordinance and contact the Building and Construction Department for more information. 

Tourist and Local Taxes

Businesses that operate a short-term rental must collect a tax from each person occupying accommodations. These excise taxes are required to be remitted to the City on or before the 20th day of each month for the preceding calendar month, accompanied by a completed Hotel/Motel/Short-term Rental Occupancy Tax Return. Short-term rental units are also subject to state sales tax. 

Other Rules

Sandy Springs require information to be posted on the door of the property with the name and contact information of the owner and the phone number of the City Call Center for notification if there are problems. It is also essential to understand and abide by other contracts or rules that bind you, such as leases, condo boards, co-op rules, HOA rules, or rules established by tenant organizations.
