Pompano Beach Short-Term Rental Regulations

City Code of Ordinances

Pompano Beach allows short-term rentals. Short-term rentals are defined as "A short-term rental is a dwelling unit that rents or leases any living quarters or accommodation by the day, week, month or any other length of time for a term of six months or less in a calendar year. An example of short-term rental may include a home posted on a website like airbnb.com, vrbo.com, or other similar services." An annual permit is required to operate a single-family, duplex, triplex, or quadplex as a short-term rental. Occupancy standards. In addition to the standards regarding occupancy in § 153.33(E), the following standards shall apply: 
  • Occupancy shall be limited to that permitted in the underlying Zoning District. 
  • In no case shall occupancy be greater than two persons per bedroom.

Business License Requirements

As part of the needed permit, various standards are involved with conducting a short-term rental in Pompano Beach. The following licenses are required of vacation rental operators:
  1. Transient Public Lodging Establishment License with the Florida Department of Business and Professional Regulations
  2. Certificate of Registration with the Florida Department of Revenue 
  3. Broward County Business Tax Receipt
  4. City Business Tax Receipt

Building and Housing Standards

Pompano Beach has rules and regulations that specify minimum building, design, maintenance standards, habitability, health, and safety requirements. Some rules and regulations that apply to residential and non-residential properties may apply to your listing. Please consult the Pompano Beach Code of Ordinances Chapter 153.26  - Minimum standards for short-term rental and contact the Building Inspections Department for more information. 

Tourist and Local Taxes

The property owner, property manager, or authorized agent must submit evidence of the vacation rental current and active account with Broward County Tax Collector/proof of Tourism Development taxes (TDT) and Florida Department of Revenue certificate of registration for purposes of collecting and remitting tourist development taxes, sales surtaxes, and transient rental taxes. 

Other Rules

If a short-term rental causes problems in the community, the city may, under certain circumstances, cancel its annual license. The following are some examples of causes for revocation:
  • Incorrect statements made on the application
  • Reoccurring determinations by the Special Magistrate of violations of the Code regarding off-street parking
  • Any noise disturbances
  • Littering/Garbage and/or other repeated Code violations
It is also essential to understand and abide by other contracts or rules that bind you, such as leases, condo boards, co-op rules, HOA rules, or rules established by tenant organizations.
